By accessing or using AIconograph ("we," "us," "Service"), you agree to be bound by these Terms of Service ("Terms"). Your continued access or use constitutes acceptance of any future updates to these Terms.

2. Eligibility

You represent that you are at least 18 years old and have the legal capacity to agree to these Terms.

3. Account & Security

Certain features require registration. You agree to:

• Be liable for all activities under your account

Notify us immediately of unauthorized use of your account.

4. Usage License

Upon purchase or download of an image, you receive a non-exclusive, worldwide, perpetual license to use the images as permitted under these Terms and any specific terms provided at the time of purchase.

5. Permitted and Restricted Uses

Permitted Uses:

• Use images in software interface designs, presentations, reports, advertising (subject to impression limitations), editorial content with proper attribution, and academic journals with appropriate credit.

Restricted Uses:

You may not:

• Use the Service or images for unlawful, defamatory, fraudulent, or harmful purposes.
• Redistribute, resell, sublicense, or otherwise make images available to third parties without express permission.
• Incorporate images into biometric databases, AI/ML training datasets, or create derivative competitive products without our written consent.
• Claim ownership or copyright of the AI-generated images beyond the licensed rights.
• Use images for defamation, harassment, discrimination, exploitation, or automated decision-making adversely affecting legal rights.
• Violate applicable laws, regulations, or third-party rights.

6. Intellectual Property

All content available on AIconograph—including images, text, code, designs, and trademarks—is the property of AIconograph or its licensors. All rights not explicitly granted are reserved.

7. Payment & Refunds

Prices and payment terms are posted at the point of purchase. All sales are final; no refunds or credits will be issued unless explicitly stated otherwise or required by law.

8. Termination

We reserve the right to suspend or terminate your access at our discretion, particularly for violations of these Terms. Upon termination, your license to use any images immediately ends.

9. Limitation of Liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, AIconograph disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

AIconograph shall not be liable for indirect, incidental, special, consequential, punitive, exemplary damages, or lost profits arising from or related to your use of the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless AIconograph, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses, including attorneys' fees, arising from your use of the Service or breach of these Terms.

11. Dispute Resolution & Arbitration

Any disputes arising under these Terms will first be subject to mediation. If mediation fails, disputes will be resolved through binding arbitration according to the American Arbitration Association rules. Both parties waive the right to a jury trial and class action.

12. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of California. Any disputes shall be arbitrated exclusively in Los Angeles County, California.

13. Changes to Terms

We may update these Terms at any time. Continued use after such updates constitutes acceptance of the new Terms.

14. Severability

If any provision is found invalid or unenforceable, the remainder of these Terms shall remain fully enforceable.

15. Waiver

Failure to enforce any provision shall not constitute a waiver of future enforcement of that provision or any other provision.

16. Entire Agreement

These Terms, along with any additional purchase terms, constitute the entire agreement between you and AIconograph regarding the Service.

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which detail our data handling practices.
